NEW YORK –– A New York City judge has denied a motion to consolidate two asbestos cases for trial, opining that the plaintiffs had failed to prove that “common issues predominate over individual ones.”

In a one-page order issued July 19, Hon. Barbara Jaffe of the New York Supreme Court for New York County noted that “the two plaintiffs did not work at a common worksite, nor did they have similar occupations; their periods of exposure differ; one is alive and suffering from lung cancer while the other died of mesothelioma….”
