Pa. Court: Asbestos Plaintiff Waived Questions by Not Presenting Them in Earlier Appeal

PHILADELPHIA –– A Pennsylvania appellate court declined to review an asbestos plaintiff’s notice of appeal, finding that she had waived the questions presented to the court by not raising them in a separate appeal.

In the July 17 opinion, the Pennsylvania Superior Court held that the plaintiff whose bid to appeal summary judgment awards for some defendants was rejected last year by the U.S. Supreme Court could not now appeal summary judgment awards entered at the same time for other defendants.
