Utah Court Refuses to Reconsider Asbestos Defendants’ Motions for Summary Judgment After MDL Court’s Denial

SALT LAKE CITY, Utah –– A Utah federal court has refused to reconsider four asbestos defendants’ motions for summary judgment, which were denied by the national Asbestos Products Liability Multidistrict Litigation judge prior to remanding the case.

In the July 15 order, the U.S. District Court for the District of Utah noted that an MDL Court’s ruling should only be overruled when there is “clear error.”

The plaintiffs allege that Joseph Alexander Anderson Jr. developed mesothelioma after he was exposed to asbestos.
