N.Y. Court Denies Motion for Summary Judgment, Finds Questions Involving Merger of Asbestos Shipbuilding Defendant

NEW YORK –– A New York court has denied summary judgment to the successor of a shipbuilder, ruling that there was enough evidence to create a question of fact as to whether the asbestos defendant’s acquisition of the boats was a de facto merger.

In the June 27 opinion, the New York Supreme Court for New York County wrote that the fact that the original company did not dissolve until 13 years after the acquisition does not merit summary judgment.
