Maryland Court Remands Asbestos Action, Says Naval Ship’s Dry Dock Status Doesn’t Confer Federal Jurisdiction

BALTIMORE –– A Maryland federal court has remanded an asbestos action after finding that a naval ship’s dry dock status did not confer federal enclave jurisdiction.

In the June 19 decision, the U.S. District Court for the District of Maryland also found that the removing defendants had not proven that the U.S. Government stopped them from providing warnings with the allegedly harmful products.

In the lawsuit, plaintiffs Michael and Anna McCurdy contend that Michael McCurdy was exposed to asbestos while serving in the U.S. Navy.
