Utah Court Excludes Plaintiff Expert Testimony, Says ‘Every Exposure’ Theory ‘Troubling’

SALT LAKE CITY, Utah –– A Utah federal court has granted defense motions to exclude “every exposure” causation testimony, finding that the plaintiff experts “did not base their opinions on scientific evidence that every exposure to asbestos causes mesothelioma.”
In its June 24 opinion, the U.S. District Court for the District of Utah wrote that the two plaintiff experts did not have enough scientific information as to the plaintiff’s specific exposure to form a causation opinion.
The plaintiffs allege that Joseph Alexander Anderson Jr. developed mesothelioma after he was exposed to asbestos.
