N.Y. Court Denies Pump Manufacturer’s Motion for Protective Order, Says Asbestos Defendant Must Produce Technical Manuals

NEW YORK –– The court overseeing the New York City’s coordinated asbestos docket has denied defendant Blackmer Pump Co.’s motion for a protective order, confirming a recommendation that required the defendant to produce technical manuals for its asbestos-containing products.

In the June 17 order, the New York Supreme Court for New York County found that the plaintiffs had proven that the technical manuals would reveal details regarding how the pumps integrated asbestos products.

The dispute arose out of Blackmer’s answers to interrogatories and requests for production filed by a number of asbestos plaintiffs represented by Weitz & Luxenberg, P.C.
