Calif. Appeal Court Affirms $2.1 Million Asbestos Verdict, Rejects Union Carbide’s Attacks on Causation

LOS ANGELES –– A California appellate court has affirmed a $2.1 million verdict, finding that defendant Union Carbide had “misstated” the plaintiff’s causation burden and ruling that the plaintiffs did not need to present testimony “specifically linking the defendant’s product in isolation to the plaintiff’s increased risk of developing cancer.”

In the June 18 opinion, the California 2nd District Court of Appeal said that the plaintiffs claims could rely on testimony establishing that the decedent was exposed to a significant amount of Calidria and that chrysotile asbestos can cause mesothelioma.
