R.I. Court Adopts ‘Frequency, Regularity, Proximity’ Standard, Refuses to Exclude ‘Each and Every Exposure’ Asbestos Evidence

PROVIDENCE, R.I. –– A Rhode Island court has denied a motion in limine filed by asbestos defendant Crane Co. to exclude “each and every exposure” evidence, saying that it has no problem with the scientific validity of the testimony.
In the June 13 opinion, however, the Rhode Island Superior Court did caution plaintiffs that while it could present evidence that “each and every exposure” contributed to the plaintiff’s injury, it must submit evidence satisfying the “frequency, regularity and proximity” standard, as well.
