JACKSON, Miss. –– A Mississippi federal court has remanded the Jones Act claims of an asbestos plaintiff, ruling that the removal of the case was defective since none of the defendants entering appearances in the action consented to the removal.
In the June 19 decision, the U.S. District Court for the Southern District of Mississippi further noted that the lone removing defendant has since been dismissed from the case.
