N.Y. Appellate Court Affirms Dismissal of Declaratory Action Involving Asbestos Coverage for Claims Against Warren Pumps

NEW YORK –– A New York appellate court has affirmed the dismissal of a declaratory action involving insurance coverage for asbestos claims asserted against Warren Pumps, noting a similar action is currently pending in Delaware.

In the June 4 opinion, the 1st Department of the Appellate Division of the New York Supreme Court found that it would be “burdensome” and “wasteful” to litigate the claims in New York when the insurer is a third-party defendant in the Delaware action.
