New York City Court Consolidates 4 More Asbestos Cases for Trial, Notes Similarities Between Injury, Work

NEW YORK –– A New York trial court has consolidated four more asbestos cases for trial, concluding that the concerns raised by the defendants in opposition of consolidation were not enough to “defeat plaintiffs’ application for a joint trial.”
In the May 13 decision, the New York Supreme Court for New York County noted the similarities between not only each of the plaintiffs’ alleged injuries, but also in the way each of the injured workers performed his job.
The lawsuits involve claims of exposure to asbestos by Frank Kestenbaum, Alberto Fernandez, Robert Spina and Carmen Wilson. Counsel for the plaintiffs …
