Calif. Court Affirms Summary Judgment Awards to Lennar, Air Quality Monitor in ‘Naturally Occurring’ Asbestos Case

SAN FRANCISCO –– A California appellate court has affirmed the dismissal of “naturally occurring” asbestos exposure claims asserted against Lennar Corp. (NYSE: LEN) and two companies it contracted to conduct soil-grading and air-monitoring services.
In the May 22 opinion, the California 1st District Court of Appeal opined that the plaintiffs’ claims not only lacked “competent expert testimony or other evidence showing causation,” but also failed to link the plaintiffs’ alleged injuries to specific toxins –– including asbestos, arsenic, iron and manganese –– found at the work site.
