Court Grants Motion to Reconsider; Cites Virginia’s New Causation Standards in Asbestos Cases

WASHINGTON, D.C. –– A federal court has granted Honeywell’s motion for reconsideration of a summary judgment motion, saying that the plaintiffs had not satisfied causation standards recently outlined by the Virginia Supreme Court.

In the May 14 opinion, the U.S. District Court for the District of Columbia found that the plaintiffs had not proven that the decedent’s alleged exposure to asbestos in Bendix brakes was more likely than not sufficient to have caused his development of mesothelioma.
