Louisiana Appellate Court Reverses Summary Judgment Award to Insurer in Take-Home Asbestos Case

NEW ORLEANS –– A Louisiana appellate court has reversed an award of summary judgment entered in favor of an insurer, finding that the plaintiff had established that a genuine issue of material fact existed in the take-home asbestos exposure case.
In the May 8 opinion, the Louisiana 4th Circuit Court of Appeal pointed to the plaintiff’s own testimony that he shook off his father’s “dusty” work clothing as support for its conclusion.
