N.Y. Court Denies Union Carbide’s Motion for Summary Judgment in Asbestos Lung Cancer Case

NEW YORK –– A New York court has denied Union Carbide’s efforts to obtain summary judgment in an asbestos lung cancer case, finding the plaintiff had submitted sufficient evidence showing that the asbestos-containing tiles in question were still being manufactured.

In the April 30 decision, Judge Sherry Klein Heitler of the New York Supreme Court for New York County additionally found that there was enough evidence on the record to support a jury analysis on the question of whether Union Carbide is protected under the bulk supplier defense.
