NEW YORK –– Union Carbide has been awarded summary judgment in an asbestos case brought by the surviving family members of a Ukrainian immigrant, ruling that the plaintiffs had failed to demonstrate that the defendant provided the asbestos-containing components in the circuit breakers and panel boxes with which the decedent allegedly worked.
In the May 3 order, the New York Supreme Court for New York County wrote that the plaintiffs’ evidence failed to establish that the facility in question even produced the allegedly harmful products.
