Calif. Appellate Court Reverses Judgment for City of Los Angeles, Reinstates Asbestos Claims

LOS ANGELES –– A California appellate court has reversed an order sustaining a demurrer to a complaint filed by a former city worker, finding the City of Los Angeles had waived its untimeliness argument when it failed to respond to the asbestos claims.

In the May 2 unpublished opinion, the California 2nd District Court of Appeal held that if the city did not provide notice to the plaintiffs that their claims were being denied, it could not later assert that the claims were not filed within the appropriate deadlines.
