Texas Appellate Court Reverses Judgment in Favor of Mexican-Based Company for Underlying Asbestos Claims

CORPUS CHRISTI, Texas –– A Texas appellate court has ordered a continuance in an asbestos coverage case, ruling that because the Mexican-based company that entered a special appearance in the proceedings did not comply with discovery requests, the parties should be allowed to engage in jurisdictional discovery.

In the April 18 opinion, the Texas 13th District Court of Appeals for Corpus Christi found the Mexican company avoided the most “benign and reasonable discovery requests” made by appellants Mt. McKinley Insurance Co. and Everest Reinsurance Co.
