Court Reverses Remand Order, Finds ‘No Evidence’ that Plaintiffs Could Recover Damages from In-State Defendants

SHREVEPORT, La. –– A Louisiana district court has reversed a magistrate judge’s decision granting asbestos plaintiffs’ motion to remand, ruling that there was no evidence that would “even arguably allow recovery” against the defendants the removing parties say were fraudulently joined to the action.

In the April 23 decision, the U.S. District Court for the Western District of Louisiana not only issued an order reversing the decision and denying the motion to remand, but it also dismissed all claims against the two in-state defendants.
