Calif. Appellate Court Reverses Nonsuit Entered in Favor of Asbestos-Containing Cement Manufacturer

LOS ANGELES –– A California appellate court has reversed a nonsuit entered in favor of asbestos defendant Amcord Inc., ruling that testimony from the decedent’s brother and two expert witnesses was enough to satisfy the burden of demonstrating that asbestos in the defendant’s gun plastic cement product was a substantial factor that contributed to the former construction worker’s mesothelioma.
In the April 18 opinion, the California 2nd District Court of Appeal additionally ruled that the trial court erred when it excluded evidence of the defendant’s lobbying efforts in favor of an amendment excluding it from asbestos regulations.
