MDL Court Adopts Recommendation Dismissing ‘Fear of Cancer’ Claims in Asbestos Case

PHILADELPHIA –– The court overseeing the national asbestos products liability multi-district litigation docket has adopted a report and recommendation that granted CSX Transportation’s (NYSE:CSX) motion for partial summary judgment on a plaintiff’s fear of cancer claims.

In the one-page April 5 order, the U.S. District Court for the Eastern District of Pennsylvania said that “upon careful and independent consideration,” CSX’s motion for partial summary judgment should be granted.

Jack B. Howell brought the claims against CSX Transportation. Howell contends that he was exposed to asbestos-containing products while working at CSX Transportation railroad shops for 35 years.
