N.Y. Court Denies Summary Judgment for Rockwell Automation, Kohler in Asbestos Case

NEW YORK –– A New York trial court has denied summary judgment motions filed by Rockwell Automation Inc. and Kohler Co., rejecting attempts by the defendants to challenge the plaintiffs’ product identification.
In the separate April 9 orders, the New York Supreme Court for New York County ruled in both motions that the disputes as to product identification should be left for the trier of fact.
The plaintiffs contend that William Lindsay was exposed to asbestos while working as a union electrician. As a result of the exposure, Lindsay developed mesothelioma, the plaintiffs allege.
