Louisiana Federal Court Remands Take-Home Asbestos Action, Rejects Georgia-Pacific’s Challenges to Sufficiency of Claims

NEW ORLEANS –– A Louisiana federal court has remanded a take-home asbestos action, ruling that Georgia-Pacific had not met the “heavy burden” of proving that two of the defendants named in the action were improperly joined.

In the April 5 opinion, the U.S District Court for the Eastern District of Louisiana also found that the plaintiff was not required to submit evidence at this stage of the litigation that would survive a summary judgment motion.

June Pitman filed the underlying claims, contending that her mesothelioma was caused by asbestos exposure that was carried home on her father’s work clothing.
