Wash. Court Affirms Denial of Washington Industrial Insurance Act Benefits to Asbestos Claimant

TACOMA, Wash. –– A Washington appellate court has affirmed the denial of Washington Industrial Insurance Act benefits to the family of a man who was allegedly exposed to asbestos in both a maritime and non-maritime setting, ruling that the family can only recover benefits under the Long Harbor Workers’ Compensation Act.

On March 19, the Washington Court of Appeals, Division II, did find, however, that the family was wrongfully denied interim benefits while it was determined whether they could recover under the LHWCA.
