Asbestos MDL Court Denies Summary Judgment for Georgia-Pacific, Says Claims Governed by Illinois Law

PHILADELPHIA –– The court overseeing the national asbestos products liability multidistrict litigation docket has denied Georgia-Pacific’s attempts to have asbestos claims thrown out under Indiana’s statute of repose.

In doing so, the U.S. District Court for the Eastern District of Pennsylvania found in the March 12 order that since the plaintiffs had only asserted claims relating to alleged exposure in Illinois, that state’s law applied.

Plaintiff Bonnie Wilson contends that her husband, Harold Wilson was exposed to asbestos while working for Acme Steel. Wilson later developed lung cancer as a result of the exposure, the lawsuit contends.
