N.C. Court Allows Amendment of Asbestos Action After Defendants Fail to Respond

RALEIGH, N.C. –– A North Carolina federal court has allowed the widow of a former auto mechanic to amend her asbestos lawsuit to include claims for wrongful death, noting that the defendants had not opposed the motion.
In the three-page order, the U.S. District Court for the Eastern District of North Carolina also allowed Jane Miller to substitute herself for her husband in the action.
In the complaint, the plaintiffs contend that Robert Wesley Miller developed mesothelioma as a result of asbestos exposure.
