N.Y. Remands Asbestos Case, Says Removal by Crane Co. was Untimely

NEW YORK –– A New York federal court has remanded an asbestos case after finding that defendant Crane Co.’s removal was untimely, according to a recent order filed by the court.

In the March 12 order, the U.S. District Court for the Southern District of New York found that the defendant had failed to refute evidence presented by the plaintiff indicating that the defendant was served with documents that allegedly gave Crane Co. grounds for removal.

Phyllis Hauck filed the complaint, contending that she was exposed to asbestos-containing products manufactured by the defendants, including Crane Co.
