NEW YORK –– A New York court has denied a summary judgment motion filed by Lennox Industries Inc., ruling that the plaintiff’s confusion over whether he was exposed to the defendant’s asbestos-containing boilers or furnaces does not preclude the claims.
In the March 8 ruling, the New York Supreme Court for New York County noted that the plaintiff was not asked to make the distinction between a furnace and a boiler, despite the fact that Lennox manufactured a line of furnaces that looked similar to boilers.
