N.Y. Court Finds Asbestos Plaintiff Presented Sufficient Evidence to Support FELA Claim

NEW YORK –– A New York court has denied summary judgment to two defendants who contended that a former railroad yard employee had not presented enough evidence to support his claims under the Federal Employers’ Liability Act.

In the March 8 order, Justice Sherry Klein Heitler of the New York Supreme Court for New York County wrote that the plaintiff’s testimony, combined with affidavits from two experts, was enough to defeat the summary judgment motion.
