New York City Asbestos Plaintiffs Ask Court to End Deferral on Punitive Damages Claims

NEW YORK –– The plaintiffs involved in the coordinated New York City asbestos litigation docket have filed a joint brief asking the court to end the deferral on punitive damage claims, arguing that it prejudices asbestos plaintiffs.
In the March 5 joint motion, filed in the New York Supreme Court for New York County, the plaintiffs argue that Section XVII of the coordinated docket’s Case Management Order (CMO), implemented in the 1990s, now actually “results in the waste of judicial resources.”
