Wis. Court Precludes Evidence Relating to Post-Sale Warnings in Asbestos Case

MADISON, Wis. –– A Wisconsin federal court has issued an order precluding an asbestos plaintiff from presenting evidence at trial to support his argument it would be have economical and technically feasible for defendant Philip Carey to issue post-sale warnings to end users of its product.
In the March 5 ruling, the U.S. District Court for the Western District of Wisconsin opined that while the plaintiff had suggested a number of ways the defendant could have implemented such procedures, he “lack[ed] sufficient evidence to support his theories and to support a reasonable jury verdict on this question.”
