Asbestos MDL Court Asks N.J. Courts to Make Ruling on Replacement Products Liability

PHILADELPHIA –– While the federal asbestos MDL Court has awarded summary judgment to several defendants in an asbestos case, the court denied with leave to refile a number of motions challenging whether defendants can be held liable for replacement parts they didn’t manufacture or supply under New Jersey law.
In a series of Feb. 7 orders, the U.S. District Court for the Eastern District of Pennsylvania noted that New Jersey law is unsettled on the topic.
