Asbestos MDL Court Remands Avondale Shipyard Case to Transferor Court for Resolution of Summary Judgment Motions

PHILADELPHIA –– The court overseeing the federal coordinated asbestos products liability litigation docket has remanded the claims of a woman who alleges she was exposed to asbestos from Avondale Shipyard, citing “complicated issues of law and fact.”

In the Feb. 1 order, the U.S. District Court for the Eastern District of Pennsylvania wrote that several issues raised in defense summary judgment motions would be better addressed by the transferor court in order to avoid “altering the parties’ positions in the case.”
