WHEELING, W.Va. –– A plaintiff firm that was found by a jury to have conspired with expert Ray Harron, M.D., in the fabrication of asbestos claims has moved for a new trial, arguing that plaintiff CSX Transportation Inc. (NYSE:CSX) relied on improperly admitted evidence during trial.

In its Jan. 18 motion, filed in the U.S. District Court for the Northern District of West Virginia, Robert N. Peirce Jr. and Louis A. Raimond contend there was “insufficient evidence to support the jury’s verdict for all of the essential elements of CSX’s claims.”
