Louisiana Court Remands Asbestos Case Removed by Texaco Inc.

LAKE CHARLES, La. –– A Louisiana federal court has remanded an asbestos action removed by Texaco Inc., rejecting the defendant’s claim that the plaintiffs had reached a settlement agreement with a non-diverse defendant.

In its Jan. 23 opinion, the U.S. District Court for the Western District of Louisiana declined to review the other arguments asserted by the defendant in favor of removal.

Plaintiff Roger Garrie filed the action, contending that he developed mesothelioma as a result of exposure to asbestos-containing products while working at industrial sites. Garrie later died as a result of his illness and his widow and son …
