PHILADELPHIA –– The court overseeing the national asbestos products liability multidistrict litigation has determined that since an amendment to Louisiana’s statute of repose was silent as to retroactive application, it can only be applied prospectively.
In the Jan. 29 opinion, the U.S. District Court for the Eastern District of Pennsylvania rejected General Electric’s (NYSE:GE) attempts to dismiss the claims on grounds that they were barred by Louisiana’s statute of repose.
