TACOMA, Wash. –– A Washington appellate court has reversed a trial court decision denying a motion for summary judgment filed by Boeing (NYSE:BA), concluding that the plaintiff had not provided enough evidence to indicate that his former employer was certain he would be injured by asbestos fibers released during a pipe repair project.
In the Jan. 29 decision, the Washington Court of Appeals, Division II, wrote that since there is no material question of fact regarding Boeing’s knowledge of the alleged danger, summary judgment was appropriate.
