FRESNO, Calif. –– A California appellate court has affirmed a demurrer entered in favor of several defendants, including General Electric (NYSE:GE), Union Carbide and Kaiser Gypsum, concluding that even after given three opportunities to do so, the plaintiff had failed to identify the specific products that caused his alleged injury.
In two separate opinions issued Jan. 17, the California 5th District Court of Appeal ruled found that the plaintiff had “not stated the essential elements of a toxic exposure cause of action.”
