Boston Court Affirms Dismissal of Insurance Dispute, Says Case Belongs in NY

BOSTON –– A Massachusetts appellate court has affirmed the dismissal of an insurance dispute, agreeing with the lower court that New York is the proper forum for the case.

In the Nov. 29 opinion, the Massachusetts Court of Appeals noted that the majority of the witnesses and documents in the case –– which involves the question of whether Colgate-Palmolive (NYSE:CL) was permitted to retain independent counsel to defend itself against asbestos claims –– are located in New York.
