Pa. Appellate Court Reinstates Verdict for John Crane, Says Plaintiff Waived Objections

PHILADELPHIA –– A Pennsylvania appellate court has reinstated a jury verdict for John Crane Inc., finding that the trial court erred when it ordered a new trial because the plaintiff’s objections were not raised during trial.
In the Nov. 20 order, the Pennsylvania Superior Court said that the plaintiffs could not contest inconsistent jury findings since they failed to raise that argument prior to the trial court’s order entering judgment on the $8 million verdict.
During the first phase of trial, jurors found that the plaintiffs had proven Shelhamer’s mesothelioma was caused by exposure to asbestos.
