MILWAUKEE –– A Wisconsin Court of Appeals has upheld the dismissal of an asbestos case filed against Honeywell (NYSE:HON), ruling that the trial court was correct in its assessment that the plaintiff had not adequately corrected a mistake regarding his legal standing as a representative of the estate.
In the Oct. 30 ruling, the appellate court noted that the plaintiff additionally did not seek to amend the complaint in an effort to fix the error until nearly two years after the lawsuit was originally filed and after the statute of limitations had run.
