LOS ANGELES –– A California appellate court has affirmed a new trial order in a take-home asbestos case that ended in a $208 million verdict, affirming a decision that threw out a jury’s allocation of 70 percent liability to defendant CertainTeed.
In the Sept. 24 order, the California 2nd District Court of Appeal agreed with the trial court’s finding that the jury erred when it did not allocate liability to a third party.
