Court Proposes Reduction of $19 Million Verdict, Upholds Liability Against General Contractor

NEW YORK –– A New York trial court has denied a motion for judgment notwithstanding the verdict filed by a general contractor who was assessed 76 percent liability for a former construction worker’s development of mesothelioma of the tunica vaginalis.
In the Sept. 20 decision, the New York Supreme Court for New York County did vacate the jury’s award of $19 million in non-economic damages and ordered a new trial on damages alone, unless the asbestos plaintiff stipulated to a reduction of the award to $8 million.
