Delaware Court Reverses Summary Judgment in Nylon Workers' Cases

DOVER, Del. - The Delaware Supreme Court has reversed summary judgment in a series of cases against Charles A. Wagner Co., Inc., filed by workers at a nylon plant who claimed they were exposed to asbestos supplied by the company. Nack, et al., v. Charles A. Wagner Co., Inc., No. 361,2001; 483,2001; 484,2001 (Del. Sup.)

In a brief opinion issued June 28, the state high court said that the evidence presented in the case upon which the previous awards of summary judgment were based was actually more akin to a case in which Wagner's summary judgment motion was rejected.
