Court Reverses Ruling Throwing Out Invoices Used by Plaintiff to Support Asbestos Claims

MADISON, Wis. -- A Wisconsin appellate court has reversed a decision that declared invoices inadmissible hearsay, concluding that the defendant had raised the "bar too high for authentication" of the documents in question. Horak, et al. v. Building Services Industrial Sales Co., et al., No. 2011AP414 (Wis. Ct. App.).

In the April 17 ruling, the Wisconsin Court of Appeals found that the invoices used by the plaintiff in support of her asbestos claims appeared to be legitimate and therefore fell under the ancient-documents exception to the general hearsay rule.
