CLEVELAND - An Ohio appeals court has upheld an award of summary judgment to Union Carbide after determining that a plaintiff failed to create a fact issue when she "stacked inferences" to allege that her husband was exposed to flooring products that contained Carbide's Calidria asbestos. Bier v. American Biltrite, et al., No. 97085 (Ohio Ct. App., 8th Dist.).
In a March 22 decision, the Eighth District Court of Appeals said plaintiff Patricia Bier cannot show that her husband was exposed to Union Carbide asbestos, even though Bier presented testimony and other evidence that the company's raw asbestos was incorporated …
