MILWAUKEE, Wis. -- A Wisconsin trial court has awarded directed verdicts to Owens-Illinois Inc. and Building Service Industrial Sales Co. midway through a take-home asbestos exposure case on state-of-the-art and product identification grounds, sources told HarrisMartin Publishing. Streng v. Building Service Industrial Sales Co., et al., No. 06-CV-5841 (Wis. Cir. Ct., Milwaukee Cty.).
On Jan. 18, Judge Kevin E. Martens of the Wisconsin Circuit Court for Milwaukee County granted the defendants' motions for a directed verdict, in part finding that it was not known in the 1950s that take-home exposure could lead to the development of mesothelioma.
