EAST ST. LOUIS, Ill. -- Asbestos claims asserted against Rockwell Automation do not belong in federal court because the defendant failed to prove that the U.S. Navy dictated what warnings should be on the defendant's asbestos-containing products, a federal court has ruled. Perakslis v. 3M Co., et al., No. 11-1111 (S.D. Ill.).
On Jan. 13, the U.S. District Court for the Southern District of Illinois concluded that there was insufficient evidence to establish that the Rockwell acted at the direction of a federal officer.
