Ala. High Court Affirms Summary Judgment Motions, Addresses Bankruptcy Dispute

MONTGOMERY, Ala. -- The Alabama Supreme Court has upheld summary judgment awards to several defendants in an asbestos action, ruling that the trial court's decision to move forward with the case even after one of the defendants filed for bankruptcy was not erroneous. Bradberry, et al. v. Carrier Corp., et al., No. 1100994 (Ala. Sup. Ct.).

In the Dec. 16 decision, the high court rejected the plaintiffs' assertions that the trial court violated an automatic stay provision of bankruptcy code when it ruled on the summary judgment motions.
